Hip implants have come a long way in successful outcomes. However, the DePuy ASR hip cup implant system is not one of them. Originally supposed to last 15 or more years, some patients who were implanted with DePuy ASR are feeling the pain far sooner.

In September 2010, DePuy sent a letter to orthopedic surgeons and hospitals confiding the new, unpublished data from the National Joint Registry of England and Wales. This data revealed the five year revision rate of requiring a second hip replacement is approximately 13 percent for the ASR hip cup implant system. Women of small stature are especially at risk.

Because of the ASR hip cup implant failure, DePuy intends to cover reasonable and customary costs of monitoring and treatment for services, including revision surgeries, associated with the recall of ASR.

But the three-fold problem is: What is considered reasonable? How much risk are patients exposed to during a revision surgery? Who pays the costs that are not considered reasonable?

DePuy's hip implant is negligent, another faulty medical device. Patients are at greater risk when medical options dictate revision surgery. Patients are not at fault.
